Aptech Learning Gurgaon is an authorised training centre offering IT, Digital Marketing & Design, banking & finance, and English language courses under the Aptech Learning brand,, with its principal place of business at M 14, Ground Floor, near SBI Bank, Block M, Old DLF Colony, Sector 14, Gurugram, Haryana 122001, India.

Aptech Learning Gurgaon operates under a licence and training authorisation agreement with Aptech Limited, and is independently responsible for admissions, batch scheduling, faculty, day-to-day operations, and placement assistance at this centre. Course curriculum and certification standards are prescribed by Aptech Limited.

Acceptance of Terms

By accessing or using the Aptech Learning Gurgaon website (aptechlearningacademy.com), any associated landing page, or any other digital asset operated by us (collectively the "Platform"), you confirm that:

• You are at least 18 years of age and legally competent to enter into a binding agreement.
• You have read, understood, and agree to these Terms & Conditions in their entirety.
• You consent to the collection and use of your personal data as described in our Privacy Policy.
• If you are accessing on behalf of a company or legal entity, you represent that you have the authority to bind that entity to these Terms.

Franchise Relationship & Aptech Limited Disclosures

Aptech Learning Gurgaon operates as an authorised training centre of Aptech Limited and is not an employee, agent, or branch office of Aptech Limited. Our relationship is governed by a separate franchise/training authorisation agreement with Aptech Limited. Key disclosures:

4.1 Curriculum & Certification

Course curriculum, examination formats, and certificates are prescribed and issued under the authority of Aptech Limited. Aptech Learning Gurgaon is responsible for local delivery, faculty, batch scheduling, and day-to-day student support.

4.2 Independent Operation

Aptech Learning Gurgaon operates as an independent entity on a principal-to-principal basis with Aptech Limited. Aptech Limited assumes no responsibility for any representations made by Aptech Learning Gurgaon that are inconsistent with official Aptech course documentation.

Enquiry & Lead Submissions

When you submit an enquiry through our website, landing pages, or advertising forms (including Google Lead Form Extensions, Facebook Instant Forms, or Microsoft Advertising lead forms), you acknowledge and agree to the following:

• The information you provide is accurate and complete to the best of your knowledge.

• Your assessment and certification data may be shared with Aptech Limited for the purpose of examination registration and certificate issuance.
• Submitting an enquiry does not constitute admission, seat reservation, or commitment of any kind until fees are paid and an admission form is signed.
• You may receive follow-up calls or messages even if your number is registered on the National Do Not Call (DNC) Registry, as your submission constitutes explicit consent to be contacted regarding your course enquiry under applicable TRAI regulations.

Digital Advertising Campaigns

Aptech Learning Gurgaon runs paid advertising campaigns on Google Ads, Facebook Ads (Meta), and Microsoft Bing Ads. All advertising conducted by us complies with the advertising policies of the respective platforms and applicable Indian law. By interacting with our advertisements:

6.1 Ad Content

All claims made in our advertisements are based on the official Aptech Limited course curriculum and are accurate to the best of our knowledge at the time of publication. However, course fees, batch schedules, faculty, and start dates are subject to change without notice. Please verify all details directly with our admissions counsellors before enrolling.

6.2 Lead Generation Advertising

We use Google Lead Form Extensions, Facebook Instant Forms, and Microsoft Advertising lead capture tools. By submitting your details through these ad formats, you consent to being contacted by Aptech Learning Gurgaon and agree that your data will be processed as described in our Privacy Policy.

6.3 Remarketing

We use remarketing lists to serve advertisements to users who have previously visited our website or engaged with our content. You may opt out of remarketing as described in our Privacy Policy.

6.4 Ad Performance Data

We use conversion tracking across all advertising platforms to measure the effectiveness of our campaigns. This may involve sharing hashed data with Google, Meta, and Microsoft. Such sharing is governed by the Data Processing Addenda of each platform.

No Guarantee of Placement or Course Outcomes

Aptech Learning Gurgaon does not guarantee:

• Admission into any specific batch at the exact date or time requested.
• That course fees, faculty, or batch schedules will remain unchanged once published.
• Any specific job offer, employer, salary, or career outcome as a result of completing a course.
• Certification by Aptech Limited, which remains contingent on meeting the prescribed attendance and assessment criteria.

All information relating to courses, fees, and batch timelines is provided for informational purposes and should be confirmed with our admissions counsellors before making any enrolment decision.

Fees & Payments

Course fees are payable directly to Aptech Learning Gurgaon at the time of enrolment, as per the fee structure communicated to you in writing. Fees may be paid in full or in instalments where an instalment plan has been offered.

Fee refunds, batch transfers, and rescheduling are governed by our separate Refund & Grievance Policy, which takes precedence over these general Terms & Conditions in the event of any conflict on that specific subject.

Intellectual Property

All content on the Aptech Learning Gurgaon website, including but not limited to the brand name, logo, text, graphics, photographs, layout, design elements, and code, is the exclusive intellectual property of Aptech Learning Gurgaon or is used with the permission of the respective rights holder.

You may not copy, reproduce, modify, distribute, publish, transmit, or create derivative works from any content on this website without prior written consent from Aptech Learning Gurgaon. The "Aptech" name, logo, course curriculum, and certification materials remain the intellectual property of Aptech Limited and are used by Aptech Learning Gurgaon under licence/authorisation.

Prohibited Conduct

By using our Platform, you agree not to:

• Submit false, inaccurate, or misleading information in any enquiry or contact form.
• Use our Platform for any unlawful, fraudulent, or abusive purpose.

Limitation of Liability

To the maximum extent permitted by applicable law, Aptech Learning Gurgaon and its owners and staff, shall not be liable for:

• Any direct, indirect, incidental, special, or consequential loss or damage arising from your use of, or inability to use, our Platform.
• Any loss arising from reliance on information provided on our website or in our advertising, including course details, fees, or batch availability.
• Any loss arising from the actions, omissions, delays, or defaults of Aptech Limited, faculty, or any other third party.
• Any loss of profits, business, revenue, goodwill, or anticipated savings.
• Any failure, interruption, or downtime of our website or digital advertising systems.

Our total aggregate liability to you for any claim arising out of or relating to these Terms, our services, or your use of our Platform shall not exceed the amount of any advisory fee paid by you to us in the preceding 12 months. Where no fee has been paid, our liability is limited to ₹10,000 (Indian Rupees Ten Thousand).

Indemnification

You agree to indemnify, defend, and hold harmless Aptech Learning Gurgaon, its proprietor, employees, agents, and authorised representatives from and against any and all claims, liabilities, damages, penalties, losses, and expenses (including reasonable legal fees) arising out of or relating to:

• Your breach of these Terms & Conditions.
• Your violation of any applicable law or regulation.
• Any false or misleading information provided by you to Aptech Learning Gurgaon.

Dispute Resolution

13.1 Good Faith Negotiation

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or our services, the parties shall first attempt to resolve the matter in good faith through direct negotiation for a period of 30 days from the date of written notice of the dispute.

13.2 Mediation

If the dispute cannot be resolved through negotiation, either party may refer it to mediation under the Mediation Act, 2023 (India) before a mutually agreed mediator.

13.3 Arbitration

If mediation fails, any dispute shall be finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (India), before a sole arbitrator mutually appointed by the parties. The seat and venue of arbitration shall be Gurugram, Haryana. The language of arbitration shall be English.

Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of India. Subject to the dispute resolution provisions above, the courts at Gurugram, Haryana shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms.

Amendments

Aptech Learning Gurgaon reserves the right to modify, update, or replace these Terms & Conditions at any time at its sole discretion. Changes will be effective upon posting the revised Terms to this page with an updated "Last Updated" date. Your continued use of our Platform following any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
